Zusammenfassung

Le programme European Research Council Human Sea entend répondre aux problématiques liées au développement des activités humaines en mer qui ont progressivement conduit à une transformation du droit de la mer et du droit maritime et qui restent aujourd'hui juridiquement peu encadrées. L'objectif du programme, coordonné par Patrick Chaumette, ancien directeur du Centre de Droit Maritime et Océanique, est de repenser les concepts nés de l'histoire des activités maritimes et de la navigation et de s'interroger sur l'intervention des Etats en mer, de leurs eaux territoriales vers la haute mer. Les compromis trouvés en 1982, vis-à-vis du droit de la mer, seront également interrogés compte tenu des menaces et des techniques nouvelles.

The Human Sea European research Council program aims to respond to the problems related to the development of human activities at sea, which lead progressively to a transformation of the law of the sea and maritime law, and remain today legally little framed. The objective of the Human Sea program, led by Patrick Chaumette, Professor of Law at the University of Nantes and former director of the Center of Maritime and Oceanic Law (CDMO), is to rethink the concepts born of the history of maritime activities and navigation and to question the intervention of States at sea, from their territorial waters to the high seas. The compromises reached in 1982 with respect to the law of the sea will also be examined in the light of threats and new techniques.

Programmé sur 5 ans (2014-2019), le programme European Research Council Human Sea (Programme financé par le 7e Programme-cadre de Recherche, ERC-2013-AdG 340770) entend répondre aux problématiques liées au développement des activités humaines en mer qui ont progressivement conduit à une transformation du droit de la mer et du droit maritime et qui restent aujourd'hui juridiquement peu encadrées. L'objectif du programme, coordonné par Patrick Chaumette, ancien directeur du Centre de Droit Maritime et Océanique, est de repenser les concepts nés de l'histoire des activités maritimes et de la navigation et de s'interroger sur l'intervention des Etats en mer, de leurs eaux territoriales vers la haute mer. Les compromis trouvés en 1982, vis-à-vis du droit de la mer, seront également interrogés compte tenu des menaces et des techniques nouvelles.

Le cinquième WorkPackage, dernier du programme consiste notamment en l’organisation d’un colloque international final, puis à la publication d’un ouvrage en anglais et français, traitant de la complexité du droit concernant les océans, orienté dorénavant vers la conservation de l’environnement marin. Les nouvelles activités en mer sont conditionnées à la protection de leur environnement. L’ouvrage sera ensuite disponible en open access 6 mois après sa publication. Le but du colloque est de tenter une synthèse des problématiques juridiques, technologiques, économiques, managériales des évolutions en œuvre et à venir.

Axes thématiques

Le colloque se déclinera autour de 4 thématiques :

  1. Les fonds marins (plateaux continentaux et zone internationale)
  2. La colonne d’eau (biodiversité et haute mer),
  3. Les activités en mer (synthèse sur la pêche, le commerce, les Energies Marines Renouvelables),
  4. La protection de l’environnement marin dans une approche ici fortement juridique (principes du droit de l’environnement, conventions régionales, droit de l’UE).

Ce colloque final n’aura pas de droits d’inscription ; les intervenants sélectionnés seront dispensés des frais de restauration, leur déplacement et hébergement à Nantes seront pris en charge par le programme. Les intervenants verront leur communication publiée dans l’ouvrage final du programme Human Sea.

Modalités de soumission

Les propositions de communications, de deux pages, doivent être accompagnées de la liste des publications récentes de l’auteur liées à la thématique du colloque. Elles doivent être transmises

avant le 25 janvier 2018

Les réponses du comité scientifique seront communiquées début février 2018.
Les qualités minimales requises pour la candidature sont :

  •  le texte doit être écrit en français ou anglais, la contribution doit être inédite,
  •  la taille du résumé doit être comprise entre 500 et 1°000 mots,
  •  la police et taille du texte doit être en Times new roman, 12, avec un interligne simple,
  •  le résumé doit préciser la problématique de la recherche ; expliciter le cadre théorique utilisé et la méthodologie mise en oeuvre,
  •  il doit contenir des résultats solidement argumentés et proposer des perspectives ou conclusions,
  •  et une bibliographie.

Les contributions écrites devront être livrées avant le 20 septembre 2018 (maximum 40°000 caractères, espaces exclus). Elles pourront être enrichies avant la fin du mois d’octobre 2018.
La parution de l’ouvrage est prévue pour le printemps 2019.

Planned for five years (2014-2019), The Human Sea European research Council program (Funded program by the 7th Framework Program Research and Development Convention ERC-2013-AdG-340770) aims to respond to the problems related to the development of human activities at sea, which lead progressively to a transformation of the law of the sea and maritime law, and remain today legally little framed. The objective of the Human Sea program, led by Patrick Chaumette, Professor of Law at the University of Nantes and former director of the Center of Maritime and Oceanic Law (CDMO), is to rethink the concepts born of the history of maritime activities and navigation and to question the intervention of States at sea, from their territorial waters to the high seas. The compromises reached in 1982 with respect to the law of the sea will also be examined in the light of threats and new techniques.

The fifth WorkPackage of the program involves the set-up of a final international conference that will be held at the La Cité, Nantes Events Center on 15 and 16 October 2018, followed by the publication of a book in English and French on the complexity of ocean law, oriented towards the conservation of the marine environment. New activities at sea are conditioned to the protection of the environment. The book will then be available in open access 6 months after its publication. The goal of the conference is to attempt a synthesis of the legal issues, technological, economic and managerial of the implemented and future evolutions.

Topic Proposals

The conference will focus on "Transforming the oceans law by the requirement of the marine environment conservation", by declining 4 themes around:

  1. Seabed (continental shelves and international zone),
  2. Water column (biodiversity and high seas), offshore activities (synthesis on fishing),
  3. Trade, Marine Renewable Energy (MRE),
  4. Protection of the marine environment in a highly legal approach (principles of environmental law, regional conventions, EU law).

This conference will have no registration fee; speakers selected will be exempt from meals, their travel and accommodation costs in Nantes will be covered by the program. Speakers will see their communication published in the final book of the Human Sea program.

Submission Guidelines

Proposals for communication, with two pages long, must be accompanied by a list of recent publications of the author related to the theme of the conference. They must be sent

before 25 January 2018

The scientific committee’s reply will be communicated at the beginning of February 2018.

The minimum qualifications required for application are:

  • the text must be written in French or English;
  • the contribution must be unpublished;
  • the size of the abstract must be between 500 and 1°000 words;
  • the font and size of the text must be Times new roman, 12 with single line spacing;
  • the abstract must specify the research problem, explain the theoretical framework used and the methodology implemented;
  • it must produce well-reasoned results and propose perspectives or conclusions ;
  • and a bibliography.

Written contributions must be delivered before 20 September 2018 (maximum 40°000 characters, excluded spaces). They may be enriched before the end of October 2018. The publication of the book is scheduled for spring 2019.
