Argument

In a broader perspective than that, strictly, of international business law or even of international trade law, this 5^th international conference in the Kazakh-Franco-Korean series, aims to mobilise analyses drawing from legal sciences and the social sciences at large. International economic law encompasses both public law and private law, holistically, by contrast with academic traditions, for example French, where this duality of public and private law acts as a summa divisio of law scholars and research institutes.

This further joint collaboration follows four previous meetings and publications having focused i/ (in Kazakhstan) on “regional law within international law”, published as a book Le régionalisme et ses limites : regards croisés franco-kazakhs in Russian in 2014 in Kazakhstan and in French in 2016 in Belgium (183 p.); ii/ (in France) on "societal mutations and legal responses", published as a book Mutations de société et réponses du droit : perspectives franco-asiatiques comparées in Russian in Kazakhstan in 2017 and in French in Belgium in 2017 (280 p.); iii/ (in Korea) on the European and Asian origins of legal and political systems: views from Korea, Kazakhstan and France, published as a book in English in 2018 in Belgium (298 p.); and iv/ (in Kazakhstan) on the Challenge of change in the legal and political systems of Eurasia and the New Silk Road, published as a book in English in 2020 in Belgium (312 p.).

All these volumes were released by Peter Lang international publishers, in the series Cultures Juridiques et Politiques. The present conference will similarly see its best papers published by the same Peter Lang in the same series, which the co-organisers wish to thank.

At the heart of such inter-university cooperative research lies the guiding principle according to which national (and regional ?) legal systems and their responses to the challenge of change must be studied both in their slow, institutional evolutions as well as in their necessarily hurried adaptations, in times of crises, and their need to legislate, then, en temps reel, while having to anticipate on further challenges still unknown, whether sheer violence such as terrorism, unpredictable health hazards such as pandemics, or political regime-change such as newly elected radical leaderships.

The economic emergence of Eurasia results from a long span of economic globalisation extending over the last sixty years or so. Since the post-WWII reconstruction, the economic recovery of the world has yielded an extra momentum even since the 1990s and the end of the cold-war divide of the planet. In a further context of globalization and increased competition in Eurasia, there has indeed been a steady trend towards the creation and strengthening of regional economic integration. Having common interests and objectives, this group of consolidated states became more successful in the global economy and gained real competitive advantages.

However, as a process centred around the Western hemisphere and the USA, this process seems to be coming to a standstill. A first manifestation of this was, in 2019, the exit of one member of the European Union or Brexit. This was followed or accompanied by the election into office of a US president who brought into office a populist and nationalist economic agenda. Third, the coronavirus or Covid-19 pandemic produced and is producing effects that hinder and hamper even further the globalisation process. The 2016 Brexit referendum showed how fast agreements, that were reached over many years of negotiations and diplomacy, can be cancelled. The ‘exit’ from the EU of such a key-participant as Britain has caused disputes, which shows that such ‘loosening’ of a union has political and economic consequences. The Brexit experience is a lesson for all integration associations in Eurasia.

Eurasia represents, as a potential, with half of the world population, or would represent if it were economically and regionally integrated, the greatest consumer market and productive capacity on earth. Based on this geo-political, and geo-economic background, this 2021 conference develops a problématique or analytical thread that probes into whether such a Eurasian economic integration is reachable or not. Contributors to the conference will analyse this relation or these relations between these events (EU developments, US elections, pandemic) as well as other Eurasian events such as the situation in Belarus, the progress of China’s BRI and of the Kazakh Nur Zhol, as a dynamic affecting all sub-regions of Eurasia and how this relation and these relations are likely to shape the structure of international economic dynamics of their legal regulations over the continent. In addition to the conference participants exploring the consequences of Brexit on the EU, the global economy and political stability in Europe and Asia, it is expected to consider the potential risks of similar situations in the integration associations of Eurasia, the negative consequences for individual States and the entire region, and how to minimize them.

As common practice, 1) international participants will pay for their own passage to Normandy; 2) the local organising committee will cover accommodation (2 days, 3 hotel nights) and meals (from dinner on 25^th May to breakfast on 28^th May); 3) the international organiser will supervise publications logistics and costs.

Peter Lang PIE has published four volumes from these Kazakh-Franco-Korean law conferences (in 2016 and 2017 in French & in 2018 and 2019 in English) in the series Cultures Juridiques et Politiques. One of the organisers of this 5^th conference is co-editor of a Peter Lang series New International Insights. A selection of the best texts presented at the 2021 in Le Havre and in Cane shall be submitted for publication to Peter Lang PIE.
