Summary

Religions differ profoundly in terms of their impact on public life, the political breadth of their scriptures, and their foundational models. Islam, for example, is not a minimalist religion of just beliefs and rituals, rather, Islam encompasses all aspects of life in its philosophical, moral, and legal outlook. However, the issue of utilizing aspects of religion in constitutions is not exclusive to the Islamic world. Many, if not most, countries around the world have included religious texts, teachings, and obligations within their constitutions. Thus, it is necessary to deal with this issue within a global and comparative framework that encompasses its political, legal and cultural dimensions.

  • A historical approach dealing with the issue of religion in constitutions within the context of time and place, attempting to explain the reasons behind the prevalence of this phenomenon in some regions and countries more than others.
  • A political approach that explores the political motivations behind constitutional texts on religion, and how these constitutional texts can be a means to serve religion and/or be used for political convenience
  • A legal approach focusing on the procedural effects of these constitutional texts, from the perspectives of political justice, state-society relations, and citizens’ rights.
  • A cultural approach treating constitutional texts on religion as part of the symbolic and moral capital and exploring these texts from the angles of social negotiation and distributive justice.
