The notion of “Economic Constitution” has now become a key concept not only in law, but also in other social sciences (economics, political philosophy, etc.). The 7^th Journées internationales David-Constant therefore propose to retrace the somewhat turbulent history of the concept and to study its current relevance within the various (state and supranational) legal orders in Europe. Coinciding with the launch (in Open Access) of the edited volume The Idea of Economic Constitution in Europe. Genealogy and Overview (Brill), this interdisciplinary symposium (held in English and French with simultaneous translation) will gather the nearly thirty contributors to the volume, in order to extend the discussions covered in the latter. Beyond the global overview of the issues in positive and comparative law, the speakers will also question the theoretical and conceptual frameworks that structure the current debates in and across law, economy and politics. 

La notion de « Constitution économique » est devenue un concept cardinal non seulement en droit, mais aussi dans d’autres sciences sociales (économie, philosophie politique, etc.). Les septièmes journées internationales David-Constant se proposent donc de retracer l’histoire, parfois mouvementée, du concept et d’en étudier l’actualité au sein des divers ordres juridiques, étatiques et supranational, qui composent l’espace européen. À l’occasion de la sortie (en open access) de l’ouvrage collectif The Idea of Economic Constitution in Europe. Genealogy and Overview (Brill), ce colloque interdisciplinaire (tenu en français et en anglais avec traduction simultanée) réunira la trentaine de contributeurs ayant participé à la rédaction du livre, afin de prolonger les discussions qui y sont amorcées. Au-delà de l’aperçu global des enjeux en droit positif et comparé, les intervenants questionneront également les cadres théoriques et conceptuels qui structurent les débats actuels entre droit, économie et politique. 

Presentation

In 1970, a seminal conference dedicated to the ‘European Economic Constitution’ took place at the University of Liège. After half a century of doctrinal debates, the notion of ‘Economic Constitution’ has now become a key concept not only in law, but also in other social sciences (economics, political philosophy, etc.). The 7th Journées internationales David-Constant therefore propose to retrace the somewhat turbulent history of the concept and to study its current relevance within the various (state and supranational) legal orders in Europe. Coinciding with the launch (in Open Access) of the book : G. Grégoire & X. Miny (eds.), The Idea of Economic Constitution in Europe. Genealogy and Overview (Brill), the event will gather the nearly thirty contributors to the volume, in order to extend the discussions covered in the latter.

The symposium will first aim to clarify the assumptions and presuppositions of the theories underlying the notion of ‘Economic Constitution’. Second, it will seek to identify the legal and political effects of economic constitutionalization. Beyond the global overview of the issues in positive and comparative law, the speakers will also question the theoretical and conceptual frameworks that structure the current debates in and across law, economy and politics. To that end, each of the three days of the conference will be devoted to a global theme:

• ‘Genealogy of the Concept - Historical and Theoretical Perspectives’;
• ‘European Economic Constitution - From Micro to Macro’;
• ‘National Economic Constitutions and Global Governance’

The conference will be held in hybrid format (on site and online) and both in English and French, with simultaneous translation, and will be organized in such a way as to encourage stimulating and interactive exchanges within the panels and between the speakers and the audience.

This collective project is coordinated by Guillaume Grégoire and Xavier Miny, researchers at the Faculty of Law, Political Science and Criminology of the University of Liège.

En 1970 avait lieu, à l’Université de Liège, un colloque pionnier consacré à la « constitution économique européenne ». Après un demi-siècle de controverses autour d’une notion désormais cardinale non seulement en droit, mais également dans d’autres sciences sociales (économie, philosophie politique, etc.), il s’agit de retracer l’histoire, parfois mouvementée, du concept et d’en étudier l’actualité au sein des divers ordres juridiques, étatiques et supranational, qui composent l’espace européen. À l’occasion de la sortie (en libre accès) de l’ouvrage collectif : G. Grégoire & X. Miny (dir.), The Idea of Economic Constitution in Europe. Genealogy and Overview (Brill), les 7^e Journées internationales David-Constant proposent dès lors de réunir la trentaine de contributeurs ayant participé à sa rédaction, afin de prolonger les discussions ouvertes par le livre.

Plus concrètement, la rencontre vise, d’une part, à clarifier les postulats et présupposés des théories relatives à la « constitution économique » et, d’autre part, à mettre au jour les effets juridiques et politiques du processus de constitutionnalisation économique. Ainsi, tout en discutant les cadres théoriques et conceptuels qui structurent les débats actuels entre droit, économie et politique, la rencontre permet également de dresser un panorama global de la thématique en droit positif et en droit comparé.

Chacune des trois journées du colloque sera pour ce faire dédiée à un thème spécifique :

• « Généalogie du concept » ;
• « Constitution économique européenne » ;
• « Constitutions économiques nationales et Global Governance ».

Prévue en format hybride (sur site et en ligne) et tenue en anglais et en français, avec traduction simultanée, la conférence est organisée de manière à susciter au maximum les échanges stimulants et dynamiques au sein des panels et entre les orateurs et le public.

Ce projet collectif est coordonné par Guillaume Grégoire et Xavier Miny, chercheurs de la Faculté de Droit, de Science Politique et de Criminologie de l’Université de Liège.
